General

Welcome to BucelliTransfers.com.

Before you begin using the BucelliTransfers.com website (herein referred to as "us", "we", or "BucelliTransfers"), please read the following Terms of Service ("Terms") carefully. The following terms of use, including the Privacy Policy ("Privacy Policy") govern your access of BucelliTransfers.com including any content, functionality and services offered on or through this website (“Site”).

By accessing this website you acknowledge that you have read, understood and agreed to be bound by these terms and conditions in full, and to comply with all applicable United States laws and regulations. You agree that these Terms have the same legal equivalency as a written contract with your written signature and satisfy any laws that require a writing or signature. You also agree that you won't challenge the validity, enforceability or admissibility of the Terms of Service on the grounds that it was electronically transmitted.

Revisons

We reserve the right to update/revise these Terms at any time. If these Terms change, the updated/revised Terms will be posted on the Terms and Conditions page on the website and we will change the "updated" date on the top of this page to reflect the date of the revision. Please check back regularly.

Refusal of Service

We reserve the right, at our discretion, to refuse service for any non-discriminatory reason, to any persons, reject performance of services on any material or cancel any orders, at any time.

Unlawful Order Submissions and/or Materials

You will only use BucelliTransfers and it's services for: lawful purposes and personal use.
You will not use BucelliTransfers to transfer, download and distribute content that (a) is unlawful or in violation to applicable law, (b) will infringe the copyright of anyone's intellectual property, (c) violates the privacy or publicity or other personal rights of others, or (d) is abusive, obscene, offensive, threatening, defamatory, hateful or pornographic.

Because of the sheer volume of media BucelliTransfers transfers, no single media is fully inspected top to bottom. However, if there is an instance where we discover that the contents of a transfer violated state and/or federal law, we reserve the right to report these contents to the proper authorities.

Upon reading this, you hereby understand and agree that any submission to transfer that violates any state or federal law will result in your immediate forfeiture of any privacy rights you may have with respect submitted media, including, but not limited to, any rights under the BucelliTransfers Privacy Policy.

Age Restrictions

BucelliTransfers offers it's services to adults with an acceptable payment method (cash or check). Anyone under the age of 18 may use our services with the supervision of a parent or guardian.

Refund/Cancellation Policy

BucelliTransfers offers no refunds after services are initiated. Payment is due half upfront and half when the job in completed. Please contact us immediately if you wish to cancel.

Often times we receive media that is unplayable or no longer transferable due to age or defect. These items will never be charged, marked as unplayable and returned to the owner at the end of the order process.

Risk of Damage

BucelliTransfers™ understands and appreciates the importance of your sentimental items. Our goal is to provide outstanding transfer service for our clients, so that they may relive and preserve their family memories, by digitizing
the following formats: videotapes, audiotapes, film reels, film slides, negative films, photographic prints and DVD’s.

We are very serious about our business, and we take many precautions to protect your submitted items. However, many of your items are decades old. Decay, deterioration and previous mishandling may have certainly happened before we have received them. No transfer system is perfect, and infrequently a submitted item of yours may become damaged through the process of being digitized. Old film reels, film slides, negative films and all tapes are especially fragile and susceptible to becoming broken and/or scratched due to their brittle nature, even if only transferred once.

Therefore, you understand and agree that there is an inherent risk in submitting your personal items to BucelliTransfers™
and that there is a very remote and unlikely chance that your videotape(s), audiotape(s), film reel(s), film slide(s), negative film(s), photographic print(s) or DVD(s) may be damaged through the process of being digitized.

By placing an order with BucelliTransfers™, you accept this risk.

Limitation of Liability

The site and all its stated services made available on the site are "as is" and "as available", unless otherwise stated.
BucelliTransfers does not represent that the services provided will be "without error"or that all flaws and irregularities will be corrected. All transferred media is unedited.
BucelliTransfers disclaims all warranties, express or implied.

If any submitted media becomes unplayable during the transfer process it will be tagged and returned to you. If you submit any item to us, you release and forever waive any claims against BucelliTransfers in the case "said media" becomes unplayable. You will be entitled only to a replacement blank VHS tape or the cost of replacing the physical VHS tape in today's market, irregardless of what was on the original VHS tape. Tape repair is an optional service provided.

Copyrighted Material

BucelliTransfers does not copy, duplicate or distribute copyrighted material in any way. If an item is received to be processed that contains copyrighted material it will be removed from the queue and labeled as such. The item will be returned to owner once the process of the whole order is complete. No additional fee is added.

Digital Millennium Copyright Act

We comply with all DMCA regulations and will comply with any claims of copyright infringement submitted.

Force Majeure

Any delay of your order due to a natural disaster, power failure affecting services or any other unforeseen event for which BucelliTransfers is not responsible for will not hold BucelliTransfers liable for loss, delay or non-service excused under applicable law.

Choice of Law

This contract is to be governed at all times by the laws of the State of New Jersey.

Arbitration

Any dispute relating in your use of the services of BucelliTransfers will require that the two parties resolve matters by binding arbitration rather than in court. Both parties agree that this dispute will happen in front of a single arbitrator. Both parties are responsible for there own arbitration fees and lawyers costs.
